Computer and employee privacy

On October 19, 2012, the Supreme Court of Canada rendered a decision which addressed certain principles applicable to the rights to privacy of employees when they use an employer’s computer. Although this is a criminal law decision, some of the principles are likely to be applied by the courts in employment matters, which invites a closer look at how the case may impact in our area of practice.
