On October 1, the Regulation respectingprevention and participation mechanisms in establishments (the RMPPÉ”) came into force, marking the end of the interim regime”and the entry into force of the permanent regime.

The resulting obligations vary depending on the size of the employer’s establishments.Employers of establishments with 20 or more workersmust set up a health and safety committee (the HSC”).

Workers must designate a health and safety representative (the“HSR”), who will sit on the HSC. In addition, aprevention program (the PP”) must be developed andimplemented. Employers who did not have a PP in place as of October 1,2025, have one year to comply. It should be noted that employers with more than one establishmentmay have to carry out the above steps for eachestablishment if they do not qualify for the multi-establishment approach, which allows establishments to be grouped together under certain conditions.For employers of establishments with 19or fewer workers, an action plan (the AP”) mustbe developed and implemented. These employers have one year to implement the AP from the time they become subject to this obligation.

These employers have one year to implement the PA from the moment they become subject to this obligation. Employees must designate a health and safety liaison officer (the HSLO”) from among themselves.

There may be some nuances if an employer falls below the threshold of 20 workers during a year or if they exceed 20 workers for a short period.

Finally, on October 6, provisions relating to the consideration of psychosocial risks (PSRs) also came into force. For employers, this means that PSRs must be identified, corrected, and controlled in the same way as other types of risks.
