On September 29, 2022, the Supreme Court of Canada granted the request for leave to appeal by Société des casinos du Québec inc., represented by Loranger Marcoux, to address an important constitutional question:
Will first-level managers have the right to unionize in Quebec under the Labor Code?
On April 23, 2023, Loranger Marcoux presented its arguments in front of the Supreme Court of Canada in support of its appeal.
Nearly a year later, on April 19, 2024, the Supreme Court issued its judgment on this new and highly anticipated question by the labor sector in Quebec and even Canada.
The Supreme Court concluded that the Labor Code, which excludes managers from the general labor relations system in Quebec, does not violate the freedom of association. Thus, the Supreme Court of Canada ruled that managers cannot unionize in Quebec under the Labor Code.
