For our clients subject to personalized rate pricing or the retrospective system, please remember that the deadline for filing a claim for apportionment (for pre-existing personal conditions), pursuant to section 329 of the LATMP, is December 31, 2025, for injuries that occurred during 2022. Please note that your request does not necessarily need to be supported by a medical opinion on file.

The most important thing is to file a request within the time limit prescribed by law. We therefore recommend that you identify the personal condition for which you are requesting a sharing of attribution and briefly explain why you believe it had an impact on your case.

In this regard, you can argue that the personal condition contributed (partially or totally) to the occurrence of the work-related injury. You can also argue that the personal condition had an impact on the consequences of the work-related injury, particularly by prolonging the recovery period or resulting in functional limitations or permanent impairment.
